Selangor puts blanket freeze on federal jobs pending AES appeal


SHAH ALAM, Feb 21 ― The Selangor government today ordered a freeze on all federal projects in the state, including highway and light rail transit (LRT) projects, pending an appeal of a landmark decision on the controversial Automatic Enforcement System (AES).
This follows a decision by a High Court today to disallow the Sepang Municipal Council (MPS) from removing the speed cameras, ruling that the federal government is the proper authority on AES rather than the local council.
“The state government also has directed its Economic Planning Unit to provide a list of federal development plans,” Mentri Besar Tan Sri Abdul Khalid Ibrahim (picture) said here in a statement.
“The plans will be checked again by the State Executive Council to ensure that the Selangor citizens’ and the state government’s interests are guaranteed.”
In response to the High Court decision, Selangor today directed the state legal advisors and the MPS’ legal department to sift through their legal notes and file an appeal.
Beta Tegap Sdn Bhd, the contractor of the AES cameras, today won its judicial review application against the MPS with a decision by Justice Datuk Zaleha Yusof.
The private firm had challenged the MPS’s notices last year to dismantle its cameras on the PLUS and SKVE highways, and had previously argued that these were declared to be federal roads and are not under Selangor’s jurisdiction.
In November last year, the MPS issued two notices instructing Beta Tegap to make a formal application for building planning permission, claiming the use of state land.
On December 12 last year, Beta Tegap filed an application for leave to seek a judicial review over the MPS decision and subsequently obtained permission in the High Court on December 19.
In the judicial review application, Beta Tegap said the municipal council, through a letter dated November 19 last year, required the company to apply for permission to install the AES poles and cameras at Km301.7 of the North-South Expressway and at Km6.6 of the South Klang Valley Expressway, both located in Dengkil, Sepang.
The MPS, in a letter dated December 6, ordered the company to dismantle the cameras within 14 days of the notice.
