Sultan of Sulu has influence in Semporna, panel told


The Sultan of Sulu had written to the Semporna district officer to protest the eviction of a civil servant from a government quarters, the Royal Commission of Inquiry on illegals in Sabah was told today.

Semporna district officer A.M Ibnu A.K Baba said this showed the extent of the sultan's influence in the area where many of the illegal immigrants originated from southern Philippines.

"I assumed the position as district officer of Semporna in 2007, and since then, I have received numerous correspondences from the Sultan of Sulu with regards to the welfare of 'his rakyat' in the area.

"There were thousands of illegal immigrants in the district who came over from southern Philippines and they have friends and relatives who have been living here for years," the district officer told the RCI five-men panel, headed by former Sabah and Sarawak Chief Justice Tan Sri Steve Shim Lip Kiong.

"These illegal immigrants also believe that one day, Semporna will return to its rightful owner, the Sultan of Sulu. Hence, the widespread support for the Sulu royalty."

Ibnu revealed that prior to the Lahad Datu incursion in February, the Sultan of Sulu had visited Semporna several times to meet "his rakyat".

He added that this was another indication of the support the sultan enjoyed here.

"Some of these illegal immigrants come to Semporna to trade and barter, but others engage in criminal activities as their main aim is to survive. They do not fear being caught by the police and convicted in court.

"This is because life in Malaysian jails is better than living in southern Philippines, struggling to eke out a living. At least in Malaysian jails, they are fed regularly and have a relatively comfortable stay."

Ibnu told the RCI panel that the majority of the population in Kampung Sri Jaya in Simunul, Semporna,was mostly of Sulu descent.  

Kampung Sri Jaya is where six policemen were killed during an ambush in March when Malaysian security forces engaged the armed Sulu terrorists.

"History shows us that Semporna and southern Philippines share ties which go back decades. Hence the ease in which illegal immigrants from southern Philippines blend in with those who are already residing here," he said.

    If the Sulus return they will be eliminated at sea, even before they breach the security net in eastern Sabah, assured Eastern Sabah Security Command (ESSCOM) Director of Intelligence, deputy commissioner Ahmad Nadzer Nordin.

    Ahmad Nadzer, who confessed that the February intrusion at Kampung Tanduo here was a result of a ‘slip-up’, believes the Sulus will return and this time it will be with vengeance on their mind.

    “We believe they will return. We expect them to come better armed, but we will be ready and waiting for them and they will not get to land at our shores,” he said.

    He said they expected the terrorists to sneak into the area using other routes and take refuge among the water villages along the 1,784 km ESSCOM coastline.

    He said although the long coastline covering 10 districts from Kudat to Tawau were “well secured” there were still “pockets” which did not fall within the range of the eight radars

    He said once these terrorists slipped pass the security net they took refuge in the many water villages which litter the ESSCOM coastline.

    “These villages must be demolished and residents resettled elsewhere.

    “All this while our (police) intelligence indicated water villages were used as hide out for criminals and smugglers, they hide their fire arms, contraband include drugs there.

    “I strongly believe it is high time for us to eradicate such threats once and for all,” he said.

    Ahmad said ESSCOM has been exploring and adopting all possible measures to improve its security network and its intelligence collecting process.

    He said cooperation with the Philippines and Indonesia security forces had also strengthened even as ESSCOM fostered closer ties with residents within the range.

    According to Borneoinsider.com, ESSCOM was currently in the midst of establishing its own SMS system to allow the public to provide information on the presence of any subversive elements or threats.

    It reported that Ahmad Nazer had also assured the public that all information provided will be seriously looked into by ESSCOM so as not to allow for a repeat of the Lahad Datu incident.

    Ahmad Nazer had earlier told a dialogue organized by the Lahad Datu Chinese Chamber of Commerce and Industry (LDCCCI) here that the Special Branch had in fact received information about the incursions as early as November and December last year.

    “But, since both sides had been living peacefully over decades, this information was not treated seriously, and we paid the price for it eventually. It was a bitter experience,” he said.

    A wary Ahmad Nazer has offered members of the public ‘direct access’ to him, urging them to either call him or email him atnadzer@rmp.gov.my and smartstar2003@yahoo.co.uk should they stumble upon suspicious groups in army fatigues or sight boats with large numbers of people in the area.

  10. Semporna district officer Abdul Mohamed Ibnu Abdul Kadir Baba said his district office did not have enough enforcement officers to conduct frequent operations, especially in the squatter areas, and relied on integrated operations with other enforcement agencies from time to time.

    The International Court of Justice has clearly emphasised the sovereignty of Sabah under Malaysia, write Rahmat Mohamad, Mohd Hazmi Mohd Rusli and Muhamad Azim Mazlan

    The recent Lahad Datu incident must be only seen as nothing more than a mere exercise of sovereign right by the Malaysian government over her territorial jurisdiction.

    United Nations Secretary-General Ban Ki-moon made an unwarranted remark that Malaysia must enter into peaceful negotiations since the party on the other side has failed to fulfil the requirement of a state personality under international law.

    It is well within the legitimate rights of Malaysia to demand unconditional surrender of the Sulu intruders and their weapons.

    International law never disregards what is lawfully justified when it comes to the paramount duty of the state to protect her citizens, particularly where their lives are in jeopardy and to restore peace and public order within its sovereign jurisdiction.

    The claim by the Sulu sultanate must be put to rest and the subterfuge brought about by international and local media and individuals cleared.

    Sabah was once under the rule of the Brunei sultanate, whose empire sprawled across Borneo. In 1658, the Sultan of Brunei ceded the northern and eastern portions of Borneo to the Sultan of Sulu in compensation for the Sulus' assistance in repressing civil war that erupted in Brunei at that time.

    The Sulu sultanate was established in 1457 by Johor-born Arab explorer and religious scholar Sayyid Abu Bakr Abirin. The capital of this sultanate was on the island of Jolo, located more than 150km east of Sabah.

    At its peak in the 18th century, the influence of the Sulu sultanate extended beyond the territory of modern day Sabah to include the southern Philippines as well.

    Alongside Brunei, the Sulu sultanate used to rule this part of the Malay archipelago.

    The advent of the colonial powers of Britain and Spain saw the gradual depletion of the influence of the Sulu sultanate. While the rest of the Philippines fell under Spanish dominion, the British took the initiative to gain power in Sabah.

    Subsequent to the cessation of the Philippines by Spain to the American colonial government, the Sulu sultanate was ultimately annexed on March 10, 1917 as a province within the Philippines.

    The last sultan recognised by the Philippine government was Sultan Mohd Mahakuttah A. Kiram who reigned from 1974 to 1986. There are currently three contenders to the throne, namely Muedzul Lail Tan Kiram, Jamalul Kiram III and Ismael Kiram II.

    On Jan 22, 1878, an agreement was signed between the Sulu sultanate and two British agents, Alfred Dent and Baron von Overback, which provided that North Borneo was either ceded or leased to the British commercial syndicate headed by these two British agents, in return for payment of 5,000 Malayan dollars per year.

    The lease was increased to 5,300 Malayan dollars a year when the leased/ceded territory was extended to include additional islands along the coast of North Borneo from Banggi Island to Sibuku Bay.

    There were discrepancies on the interpretation of this treaty as the British version applied the word "grant and cede" while the Sulu version adopted the word "lease in perpetuity".

    By virtue of the findings of the Cobbold Commission, North Borneo joined the Federation of Malaysia in 1963 and was renamed "Sabah". Until today, the Malaysian embassy in Manila continues to pay nominal "cession money" to the heirs of the Sulu sultanate, amounting to RM5,300 (73,940 Filipino pesos) per year.

    If the British version of the treaty is adopted, then it is clear that the Sulu sultanate had ceded Sabah to the British. If the Sulu version is adopted, then, the word "lease" would come into the picture.

    When Hong Kong was leased to Britain by China, the sovereignty over Hong Kong remained with Britain until the end of the lease in 1997, which saw Hong Kong placed under Chinese rule.

    It is different with the Sabah case as this lease is "in perpetuity". Even if such a lease exists, the sovereignty over Sabah would be with Malaysia so long as Malaysia fulfils the payment of RM5,300 to the Sulu heirs. The Sulu heirs have no right to refuse the lease as it takes effect "in perpetuity".

    The Philippines claimed sovereignty over Sabah when Sabah joined Malaysia in 1963 but agreed in 1977 not to pursue the claim.

    In 2008, Sabah Chief Minister Musa Aman saw the initiative made by Nur Misuari, a leader of the Moro National Liberation Front (MNLF) to take Sabah to the ICJ was a non-issue. Neither the MNLF nor the Sulu sultanate possesses an international legal personality.
