Zahid's "wild" and "reckless" claims on IPCMC defies logic - Guan Eng
Home Minister Datuk Seri Dr Ahmad Zahid Hamidi continues to surprise Malaysians with his reckless claims and perverse logic that establishing the IPCMC will result in overlapping jurisdictions and laws among the county's enforcement agencies, as well as being unconstitutional and contrary to the concept of justice.
Where is the logic of the Home Minister that the Royal Commission Of Inquiry into PDRM, is making an unconstitutional proposal of setting up an IPCMC, when its chairman Tun Mohamed Dzaiddin Bin Haji Abdullah was the 9th Chief Justice of Malaysia?
This is the first time since the recommendations were first made in 2005 that the IPCMC has been declared unconstitutional by the BN Federal government as a flimsy excuse for rejecting its establishment. Zahid’s wild claim is a slur on the reputation of the highest judge in Malaysia and questions his basic legal competency in making an unconstitutional proposal.
Zahid is not a lawyer and he should ask the Attorney-General Tan Sri Abdul Gani Patail to forward legal arguments how setting up the IPCMC is unconstitutional. Should Zahid fail to prove his claims, he should apologise to Tun Mohamed Dzaiddin for putting Tun Dzaiddin’s legal expertise into disrepute.
Such wild claims by the Home Minister to justify the unjustifiable and defend the indefensible in the face of overwhelming factual evidence to the contrary, has been the governing approach adopted by the BN Federal government.
Ignorance
When Suhakam chairperson Hasmy Agam opposed the reinstatement of the Emergency Ordinance (EO), an upset police officer Senior Assistant Commissioner Mohad Nazir openly repudiated Hasmy by saying that "prevention is better than cure".
Hasmy had correctly pointed out the Royal Canadian Mounted Police, Scotland Yard, Interpol, the Los Angeles Police Department and the Victoria Police as notable examples of good policing without an EO.
In response, Mohad retorted that even the United States had the Patriot Act and Guantanamo Bay for the purpose of homeland security. Mohad is wrong because such laws in the United States are intended to combat terrorism and not crime.
Such ignorance by Mohad cannot be faulted as the Home Minister is also equally guilty, giving full credence to the adage that “a little knowledge is a dangerous thing”.
However Ahmad Zahid cannot be so easily forgiven for continuing to sully the reputation of his office by failing to uphold the laws but instead choose to conveniently label any proposal that the BN government wishes to reject as “unconstitutional”.

    Menteri Dalam Negeri Datuk Seri Dr. Ahmad Zahid Hamidi menolak dakwaan mengatakan kebanyakkan kematian dalam tahanan berpunca daripada keganasan polis, sebaliknya menegaskan ia disebabkan oleh penyakit yang dihidapi oleh tahanan.

    Menurut Ahmad Zahid, rekod kematian daripada tahun 2000 hingga Mei 2013 adalah sebanyak 231 keseluruhan dan hanya dua kematian yang dicatatkan adalah berpunca daripada pihak polis.

"Daripada 231 kes, 196 tahanan mati akibat daripada penyakit asma, HIV dan serangan jantung," kata Ahmad Zahid menjawab soalan yang dikemukakan oleh ahli Parlimen Sungai Petani (PKR) Datuk Johari Abdul di Dewan Rakyat.

    Ahmad Zahid juga menangkis persepsi perkauman yang cuba diwujudkan melibatkan isu kematian dalam tahanan khususnya melibatkan masyarakat kaum India.

    "Kematian dalam tahanan yang cuba dikatakan perkauman adalah tidak benar, daripada jumlah 231 kematian seramai 97 adalah Melayu, 49 Cina, 51 India, 25 warga asing dan 9 lagi adalah lain-lain," terang Ahmad Zahid lagi.

    Selain itu, beliau turut mempertahankan pendirian tiada keperluan untuk Putrajaya menubuhkan Suruhanjaya Bebas Aduan dan Salah Laku Polis (IPCMC) kerana mekanisma sedia ada iaitu Suruhanjaya Integriti Agensi Penguatkuasaan (EAIC) juga menjalankan proses yang sama.

    "Kami telah pertimbangkan dengan sewajarnya... apa yang diterima adalah lebih baik, meliputi agensi penguatkuasaan yang lain," katanya lagi.

    Isu kematian dalam tahanan Kematian telah mencetuskan reaksi negatif pelbagai pihak, malahan pembangkang dari Pakatan Rakyat (PR) telah mendesak Ahmad Zahid mengambil tindakan tegas terhadap anggota polis terlibat dengan menangkap mereka, dan bukannya hanya menukar kepada tugasan pejabat.

    Malahan, Hakim Mahkamah Tinggi Datuk VT Singham hari ini juga secara terbuka menyokong cadangan untuk menubuhkan IPCMC dengan segera bagi menangani peningkatan kes kematian dalam tahanan, semasa membacakan penghakimannya dalam kes saman ke atas polis dan kerajaan yang dikemukakan oleh keluarga seorang tahanan yang meninggal dunia, A Kugan.

  19. MANA-MANA PIHAK TIADA YANG TERKECUALI DARI TINDAKAN UNDANG-UNDANG JIKA MEMANG DIDAPATI BERSALAH

    Ketua Pegawai Eksekutif EAIC Nor Afizah Hanum Mokhtar berkata baru-baru ini kepada The Malaysian Insider suruhanjaya itu tidak menyiasat kes kematian tahanan sebelum ini kerana kekurangan tenaga kerja.

    Menurut kumpulan hak asasi SUARAM, terdapat 218 kes kematian dalam tahanan yang didakwa berlaku di Malaysia dari tahun 2000 hingga bulan ini, dengan rekod menunjukkan sembilan daripada kes tersebut berlaku pada tahun 2012, manakala lapan kes kematian setakat ini dilaporkan berlaku dalam tempoh lima bulan tahun ini.

    Satu Kumpulan Kerja Pertubuhan Bangsa-bangsa Bersatu mengenai Penahanan Sewenang-wenang 2010 (United Nations Working Group on Arbitrary Detention 2010) yang melawat penjara Malaysia dan pusat tahanan melaporkan pada 2011 bahawa antara 2003 hingga 2007, "seramai 1,500 orang mati semasa ditahan pihak berkuasa".

  21. KERJASAMA AMAT PENTING UNTUK SELESAIKAN ISU INI DAN BUKANNYA CUBA POLITIKKAN UNTUK KEPENTINGAN SENDIRI

    Majlis Peguam, kumpulan masyarakat sivil dan beberapa ahli politik dari kerajaan dan pembangkang telah mendesak IPCMC ditubuhkan untuk melaksanakan reformasi terhadap pasukan polis semenjak 2006. - 26 Jun, 2013.
